Terms of service
1.1 What these terms cover. These are the terms and conditions on which we supply products to you through ffsbeauty.eu, whether these are goods, services or digital content, to customers resident in the European Union.
1.2 Why you should read them. Please read these terms carefully before you submit your order to us. These terms tell you who we are, how we will provide products to you, how you and we may change or end the contract, what to do if there is a problem, and other important information. If you think there is a mistake in these terms or require any changes, please contact us to discuss.
2.0 Information about us and how to contact us
2.1 Who we are. We are FFS Beauty Ltd, a company registered in England and Wales. Our company registration number is 09390238 and our registered office is at FFS Beauty Ltd, Unit 6 Primary Point, Progress Drive, Cannock, WS11 0JF, United Kingdom. Our UK VAT number is GB216137728. All orders placed through ffsbeauty.eu are dispatched from the United Kingdom. We are registered under the EU Import One-Stop Shop (IOSS) scheme, so EU VAT is included in the price you pay at checkout and there are no additional customs charges to pay on delivery.
2.2 How to contact us. You can contact us by writing to us at info@ffs.co.uk or FFS Beauty Ltd, Unit 6 Primary Point, Progress Drive, Cannock, WS11 0JF, United Kingdom.
2.3 How we may contact you. If we need to contact you, we will do so by telephone or by writing to you at the email address or postal address you provided on your account.
2.4 "Writing" includes emails. When we use the words "writing" or "written" in these terms, this includes emails.
2.5 Your consumer rights are protected. Although we are a UK company, if you are a consumer resident in the European Union, nothing in these terms removes or reduces the mandatory consumer protection rights you are entitled to under the law of the EU member state in which you live. Where these terms are silent, or would otherwise conflict with those mandatory rights, your local consumer protection law takes precedence.
3.0 Our contract with you
3.1 How we will accept your order. Our acceptance of your order takes place when we email you to confirm and accept it, at which point a contract comes into existence between you and us.
3.2 If we cannot accept your order. If we are unable to accept your order, we will tell you and will not charge you for the product. This might be because the product is out of stock, because of unexpected limits on our resources which we could not reasonably plan for, because your payment method was declined, because we have identified an error in the price or description of the product, or because we are unable to meet a delivery deadline you have specified.
3.3 Your order number. We will assign an order number to your order and tell you what it is when we accept your order. It will help us if you can tell us the order number whenever you contact us about your order.
4.0 Our products
4.1 Products may vary slightly from their pictures. The images of products on our website are for illustrative purposes only. Although we have made every effort to display colours accurately, we cannot guarantee that a device's display accurately reflects the colour of the products. Your product may vary slightly from those images.
4.2 Product packaging may vary. The packaging of the product may vary from that shown in images on our website.
5.0 Your rights to make changes
5.1 If you wish to change or cancel your order before it has been fulfilled, please contact us or submit your request through your account portal. We will let you know if the change or cancellation is still possible.
5.2 Once an order has been fulfilled, it can no longer be cancelled prior to dispatch. However, you may still have the right to return your order under our Returns & Refund Policy and clause 8 below.
6.0 Our rights to make changes
6.1 Minor changes to the products. We may change the product: (a) to reflect changes in relevant laws and regulatory requirements, which will not affect your use of the product but may affect the type or origin of materials used; and (b) to implement minor technical adjustments and improvements, for example to the manufacturing process, quality of materials, or user experience, which will not affect your use of the product.
6.2 More significant changes. We may sometimes need to make more significant changes to these terms or the product. If we do, we will notify you and you may contact us to end the contract before the changes take effect and receive a refund for any products paid for but not received.
7.0 Providing the products
7.1 Delivery costs. The costs of delivery will be as displayed to you on our website.
7.2 When we will provide the products. During the order process we will let you know when we will provide the products to you. If the products are an ongoing service or subscription, we will also tell you when and how you can end the contract. You can find the specific details of your subscription by logging into your account area on ffsbeauty.eu.
7.2.1 One-off goods. We deliver goods as soon as reasonably possible. Orders are sent via Royal Mail and usually arrive within 7 working days, and in any event within 14 working days. If your order has not arrived after 14 working days, please contact us and we will do everything we can to help. In any event, we will deliver within 30 days of accepting your order.
7.2.2 Ongoing subscription goods. We will supply the goods in accordance with the terms of your subscription until you end the contract as described in clause 8, or we end the contract as described in clause 10.
7.3 We are not responsible for delays outside our control. If our supply of the products is delayed by an event outside our control, we will contact you as soon as possible and take steps to minimise the effect of the delay. Provided we do this, we are not liable for delays caused by the event, but if there is a risk of substantial delay you may contact us to end the contract and receive a refund for any products you have paid for but not received.
7.4 If you are not at home when the product is delivered. Our subscription boxes are designed to fit through most standard letterboxes. If a parcel cannot be posted through your letterbox and no one is available to take delivery, Royal Mail will usually leave a card explaining how to arrange redelivery or collection.
7.5 Your legal rights if we deliver goods late. You have legal rights if we deliver goods late. If we miss the delivery deadline, you may treat the contract as at an end straight away if: we have refused to deliver the goods; delivery within the deadline was essential, taking into account the circumstances; or you told us before we accepted your order that delivery within the deadline was essential.
7.6 Setting a new deadline for delivery. If you do not wish to treat the contract as at an end straight away, or do not have the right to do so under clause 7.5, you may give us a new, reasonable deadline for delivery, and treat the contract as at an end if we do not meet it.
7.7 Ending the contract for late delivery. If you end the contract for late delivery under clause 7.5 or 7.6, you can cancel the order for any goods, or reject goods already delivered, and we will refund any sums you have paid for the cancelled goods and their delivery. Please contact us to arrange this.
7.8 When you become responsible for the goods. A product which is goods becomes your responsibility from the time we deliver it to the address you gave us.
7.9 When you own goods. You own a product which is goods once we have received payment in full.
7.10 What happens if you do not give us required information. We need certain information from you to supply the products, such as the product type and your name and address, normally taken from your account. If you give us incomplete or incorrect information, we may either end the contract, or make a reasonable additional charge to compensate us for extra work required as a result.
7.11 Reasons we may suspend supply. We may suspend supply of a product to deal with technical problems, make minor technical changes, update the product to reflect changes in relevant laws, or make changes requested by or notified to you under clause 6.
7.12 Your rights if we suspend supply. We will contact you in advance where possible. We will adjust the price so you do not pay for products while supply is suspended, and you may contact us to end the contract for a product if we suspend it, receiving a refund for any sums paid in advance for the affected period.
7.13 We may suspend supply if you do not pay. If you do not pay on time, or your card cannot be charged, we reserve the right to make further attempts to charge it. If payment is still not made within 30 days of us reminding you, we may suspend your subscription until outstanding amounts are paid. We will not suspend products where you are genuinely disputing an unpaid invoice.
8.0 Your rights to end the contract, including your right to change your mind
8.1 You can always end your contract with us. Your rights when you end the contract depend on what you have bought, whether anything is wrong with it, and when you decide to end the contract: if the product is faulty or misdescribed, see clause 11; if you want to end the contract because of something we have done, see clause 8.2; if you have simply changed your mind, see clause 8.3 for your right of withdrawal, which may be subject to deductions and return costs; in all other cases, see clause 8.6.
8.2 Ending the contract because of something we have done or are going to do. If you are ending the contract for one of the following reasons, the contract ends immediately and we will refund you in full for any products not yet provided, and you may also be entitled to compensation: we have told you about an upcoming change to the product or these terms which you do not agree to; we have told you about an error in price or description and you do not wish to proceed; there is a risk of significant delay due to events outside our control; we have suspended supply for technical reasons for more than 30 days; or you have a legal right to end the contract because of something we have done wrong, including late delivery.
8.3 Your right of withdrawal (change of mind). If you are a consumer resident in the European Union, you have a legal right to withdraw from your purchase within 14 days of receiving your goods, without giving any reason. This is your right of withdrawal under the EU Consumer Rights Directive (2011/83/EU), as implemented in the national law of your country of residence.
8.3.1 How to exercise this right. To exercise your right of withdrawal, you can submit a cancellation request through your account portal by selecting the relevant order, or contact our Customer Experience team before the withdrawal period expires. You do not need to give a reason, but you must inform us clearly of your decision to withdraw. You may use the model withdrawal form set out in the Annex to this document, though this is not compulsory.
8.3.2 Returning the goods. If you exercise your right of withdrawal, you must send the goods back to us without undue delay and in any event within 14 days of telling us you wish to withdraw. Unless the goods are faulty, damaged, or sent in error, you are responsible for the direct cost of returning them.
8.4 When you don't have the right of withdrawal. You do not have a right of withdrawal in respect of sealed goods which are not suitable for return for reasons of health protection or hygiene, where they have been unsealed after delivery. This applies, for example, to unsealed razor blades, dermaplaning tools, and opened skincare or bodycare products. This does not affect your rights if the product turns out to be faulty.
8.5 How long do I have to change my mind? You have 14 days after the day you, or someone you nominate, receive the goods, unless: your goods are split into several deliveries over different days, in which case you have 14 days from the day you receive the last delivery; or your goods are supplied on a subscription basis, in which case your withdrawal period runs for 14 days from the day you receive the first delivery under your subscription.
8.6 Ending the contract where we are not at fault and there is no right to change your mind. Even if we are not at fault and you have no right of withdrawal, you can still end the contract before it is completed by contacting us. The contract will end one calendar month after the day you contact us, and we will refund any advance payment for products which will not be provided after that date.
9.0 How to end the contract with us
9.1 Tell us you want to end the contract. The quickest way to request a cancellation, withdrawal, or return is through your account portal by selecting the relevant order. Alternatively, you can contact our Customer Experience team at info@ffs.co.uk. Please include your name, order number, and the email address used to place your order.
9.2 Return postage. If the products are faulty, misdescribed, or you are ending the contract due to something we have done wrong (as described in clause 8.2), we will cover the reasonable cost of return. If you are returning goods because you have changed your mind under your right of withdrawal, you are responsible for the direct cost of returning them.
9.3 How we will refund you. We will refund the price you paid for the products, including standard delivery costs where applicable, using the payment method you used to pay. We may make deductions from the refund as described below.
9.4 Deductions from refunds when exercising your right of withdrawal. We may reduce your refund to reflect any reduction in value of the goods, if this results from unnecessary handling by you, that is, handling beyond what is necessary to establish the nature, characteristics, and functioning of the goods. If we refund you before we are able to inspect the goods and later discover unnecessary handling, you must pay us an appropriate amount. The maximum refund for delivery costs is the cost of the least expensive standard delivery option we offer.
9.5 When your refund will be made. We will make any refund due to you without undue delay. If you are exercising your right of withdrawal, your refund will be made within 14 days of the day we receive the goods back from you, or, if earlier, the day you provide evidence that you have sent them back to us. We may withhold the refund until we have received the goods back or you have supplied such evidence.
10.0 Our rights to end the contract
10.1 We may end the contract if you break it. We may end the contract for a product by writing to you if you do not make a payment when due and still do not pay within 14 days of a reminder, do not provide information we reasonably need to supply the products within a reasonable time, or do not allow us to deliver the products within a reasonable time.
10.2 You must compensate us if you break the contract. If we end the contract under clause 10.1, we will refund any money paid in advance for products not provided, but may deduct reasonable compensation for net costs we incur as a result of your breach.
10.3 We may withdraw the product. We may write to you to let you know we are going to stop providing a product. We will give at least 30 days' notice and refund any sums paid in advance for products which will not be provided.
11.0 If there is a problem with the product
11.1 How to tell us about problems. If you have any questions or complaints about a product, please contact us at info@ffs.co.uk or FFS Beauty Ltd, Unit 6 Primary Point, Progress Drive, Cannock, WS11 0JF, United Kingdom.
11.2 Summary of your legal rights. We are under a legal duty to supply products which conform to this contract. Under EU law, in particular Directive (EU) 2019/771 on contracts for the sale of goods as implemented in your country of residence, goods must match their description, be fit for purpose, and be of satisfactory quality. If goods do not conform, you are generally entitled to have them brought into conformity by repair or replacement, free of charge, or, in certain circumstances, to a price reduction or to end the contract and obtain a refund. The statutory guarantee period, and the period during which a lack of conformity is presumed to have existed at delivery, vary between EU member states, so please refer to the specific rules that apply where you live. Nothing in these terms affects your legal rights.
11.3 Your obligation to return rejected products. If you wish to exercise your legal rights to reject products, please contact our Customer Experience team at info@ffs.co.uk for return instructions.
12.0 Price and payment
12.1 Definitions. The "Initial Subscription Date" is the date of the first payment for a subscription. A monthly subscription requires payment every 30 days after the Initial Subscription Date.
12.2 Where to find the price for the product. The price of the product, which includes VAT, will be the price shown on the order pages when you placed your order. You can amend your payment details at any time in your account area.
12.3 Changes in VAT. If the applicable rate of VAT changes between your order date and the date we supply the product, we will adjust the VAT you pay, unless you have already paid in full before the change takes effect.
12.4 What happens if we got the price wrong. We normally check prices before accepting your order. Where the correct price is lower than stated, we will charge the lower amount. Where the correct price is higher, we will contact you for instructions before accepting your order. If an order is processed with an obvious pricing error that you could reasonably have recognised as a mistake, we may end the contract, refund any sums paid, and require the return of any goods provided.
12.5 When and how you must pay. Payments are made by credit or debit card, in Euros. Payments are processed by our third-party payment processor, Stripe. You must pay for products before we dispatch them. It is your responsibility to keep your payment details up to date for the duration of your subscription.
12.6 We may change our prices. We may change our prices at any time, giving you at least 30 days' notice. If you do not agree to a price change, you have the right to end your subscription.
12.7 What to do if you think an invoice is wrong. Please contact us promptly. You will not be charged interest until the dispute is resolved, after which we will charge interest on correctly invoiced sums from the original due date.
13.0 Our responsibility for loss or damage suffered by you
13.1 We are responsible for foreseeable loss and damage caused by us. If we fail to comply with these terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breach or of our failing to use reasonable care and skill, but not for loss or damage that is not foreseeable.
13.2 We do not exclude or limit liability where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for breach of your legal rights in relation to the products as summarised in clause 11.2, and for defective products under applicable product liability law, including the EU Product Liability Directive as implemented in your country of residence.
13.3 We are not liable for business losses. We only supply products for domestic and private use. If you use a product for commercial, business, or resale purposes, we have no liability to you for loss of profit, loss of business, business interruption, or loss of business opportunity.
14.0 How we use your personal information
14.1 We will only use your personal information as set out in our Privacy Policy.
15.0 Other important terms
15.1 We may transfer this agreement. We may transfer our rights and obligations under these terms to another organisation. We will contact you if we plan to do this, and if you are unhappy with the transfer, you may contact us to end the contract within 14 days and we will refund any advance payments for products not provided.
15.2 You need our consent to transfer your rights. You may only transfer your rights or obligations under these terms to someone else if we agree to this in writing.
15.3 Nobody else has any rights under this contract. This contract is between you and us. No other person has any rights to enforce any of its terms.
15.4 If a court finds part of this contract unlawful, the rest continues in force. Each paragraph of these terms operates separately. If any court or authority decides any of them are unlawful, the remaining paragraphs remain in full force and effect.
15.5 Even if we delay in enforcing this contract, we can still enforce it later. If we do not immediately insist that you do something required under these terms, or delay in taking steps in respect of a breach, that does not mean you no longer have to do it, and does not prevent us taking steps later.
15.6 Which laws apply to this contract and where you may bring legal proceedings. These terms are governed by the laws of England and Wales. If you are a consumer resident in the European Union, this choice of law does not deprive you of the protection of any mandatory provisions of the law of your country of residence. You may bring proceedings relating to these terms in the courts of England and Wales, or, if you are an EU consumer, in the courts of the EU member state in which you are resident.
